Terms of Service

(Sorry, our lawyers insisted, eh!)

The following Terms of Service must be accepted prior to booking:

  1. Refusal of service: Alset Tours reserves the right to refuse service to anyone for any reason at any time. Alset Tours strives to create an ideal experience for our customers. If you’re not happy, neither are we.

  2. Cancellation policy: Alset Tours processes payment in full in the case of no-shows or trips cancelled with less than 48 hours notice. Late starts will likely affect our ability to deliver regularly scheduled services. Please contact us by telephone at least 48 hours to your booking to avoid cancellation charges. We will always do our best to be considerate of your ongoing needs and respectfully request your understanding of ours.

  3. Prices: All prices are current at the time of publication and subject to change without notice.

  4. Sample Itineraries: All sample itineraries, estimated times, and service descriptions, including food & beverages are subject to weather, traffic conditions, mechanical issues and conditions beyond the control of Alset Tours. Alset Tours strives to exceed customer expectations and will attempt to provide substitute services of equal value where departures from planned itineraries are necessary.

  5. No Warranties Or Representations: THE INFORMATION ON THESE INTERNET SITES IS PROVIDED BY NEW AGE VENTURES, INC., OPERATING AS ALSET TOURS, "AS IS" AND TO THE EXTENT PERMITTED BY LAW, IS PROVIDED WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSE, OR NON INFRINGEMENT. WHILE THE INFORMATION PROVIDED IS BELIEVED TO BE ACCURATE, IT MAY INCLUDE ERRORS OR INACCURACIES. THESE INTERNET SITES MAY CONTAIN LINKS TO EXTERNAL SITES WHICH ARE NOT UNDER THE CONTROL OF NEW AGE VENTURES, INC. THEREFORE WE ARE NOT RESPONSIBLE FOR THE CONTENT OF ANY LINKED SITE. NEW AGE VENTURES, INC. IS PROVIDING THESE LINKS TO YOU ONLY AS A CONVENIENCE, AND THE INCLUSION OF ANY LINK DOES NOT IMPLY ENDORSEMENT BY NEW AGE VENTURES, INC. OF THE LINKED SITE.

  6. Payment Terms for Services: These Terms of Service describe your agreement to pay for Alset Tours services and charges. Alset Tours may amend these terms and any changes are effective when posted to this page. Alset Tours may collect payment from you by using PayPal (for full terms of service, please see the PayPal User Agreement at: https://www.paypal.com/ca/webapps/mpp/ua/legalhub-full?locale.x=en_CA) and/or the customer’s credit card information whether presented in person or over the telephone. Charges may include taxes as required by law. If we are unable to collect payment, we may contact you based on your information on file, or may request payment when we are performing services for you.

  7. Acknowledgment of Risk: You acknowledge and agree that you are voluntarily participating in the Activities (which include all activities and excursions provided, arranged, sponsored or authorized by Alset Tours including, but not limited to, biking, hiking, climbing, swimming, activities on lakes, rivers and/or oceans, including boating, canoeing, kayaking, paddle boarding, whale watching, and all activities, services and use of facilities either provided by or arranged by Alset Tours, transportation, accommodation, food and beverage, and all travel by, operation of or movement around vehicles).  You understand there are risks associated with participating in the Activities which could result in damage or loss to your or other’s property, injury, aggravation of previous injuries, or death and you voluntarily accept the risks involved.  Risks may include but are not limited to: unsafe road conditions, equipment failure, slips, falls and impacts or collision with other persons, equipment or objects, negligence of other persons, and negligence on the part of Alset Tours. You are advised to wear safety equipment including seat-belts and other protective equipment while participating in the Activities and you have a personal responsibility to learn and follow rules and procedures established by Alset Tours or the organizers of the Activities.  ALSET TOURS TAKES NO RESPONSIBILITY FOR THE ACTIVITIES PROVIDED BY A THIRD PARTY.

  8. Waiver of Claims and Release of Liability:  YOU AGREE TO WAIVE ANY AND ALL CLAIMS that you have or may have in the future against Alset Tours and TO RELEASE Alset Tours from any and all liability for any loss, damage, expense or injury including death that you may suffer, or that your next of kin may suffer as a result of your participation in the Activities, due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care under the Occupiers Liability Act, on the part of Tesla Tours, and further including the failure on the part of Alset Tours to take reasonable steps to safeguard or protect you from the risks, dangers and hazards of the Activities. 

  9. Indemnity: You agree you are responsible for all damage or loss of, or to, the property of Alset Tours, including all vehicles, furnishings, equipment or other property, caused directly or indirectly by you or your invitees, and for any property damage or personal injury to any third party resulting from your participation in the Activities.  You agree to HOLD HARMLESS AND INDEMNIFY ALSET TOURS from any claims relating to the foregoing.
    Agreement with Terms and Conditions:  If you do not agree with these terms of service, you may cancel your reservation without penalty within 24 hours of making your reservation.

  10. General: This agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity. This agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction. Any litigation involving the parties to this Agreement shall be brought solely within the Province of British Columbia and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia. This Agreement represents the entire Agreement between the parties with regards to the subject matter contained herein.
